Medical Negligence

$12 million jury verdict against hospital for negligently failing to obtain a surgical consultation by a pediatric surgeon in its neonatal intensive care unit  (NICU)for a premature infant transferred there specifically for that purpose.  After the hospital’s doctors failed to obtain the consultation, the infant ultimately died from a common complication associated with prematurity called necrotizing enterocolitis (NEC).  The individual physicians settled the parents’ claims against them out of court for the limits of their liability coverage.

$15 million jury verdict against a pediatric emergency room physician for her negligence in effectively abandoning her patient, a 15 month old boy who died in the emergency room from respiratory complications.

$1.65 million jury verdict for a surgeon’s negligent hernia repair, resulting in loss of the male patient’s sole remaining testicle.

1.5 million settlement with hospital and emergency room physicians for failure to diagnose flesh eating bacteria in a four year old boy resulting permanent injuries to the child’s penis and scrotum.

$1.5 million jury verdict against a physician for sexual molestation of his patient.

$ 1 million settlement with nurse midwife and hospital due to failure to recognize fetal distress and deliver by cesarean section.

$900,000 jury verdict against a primary care physician and managed care clinic for failure to diagnose deep vein thrombosis leading to pulmonary emboli and permanent disability.

$738,000 jury verdict for a surgeon’s negligent performance and positioning of the plaintiff during bladder surgery resulting in femoral neuropathy.

$400,000 settlement with hospital for negligent care post esophageal cancer surgery; the plaintiff was so sorely neglected by the staff that he developed bilateral peroneal neuropathy (drop foot), a Vancomycin-resistant enterococci (VRE) infection, and bedsores to his head, shoulder blades, buttocks and heels.

$250,000 settlement (maximum available under physician’s insurance policy) with negligent surgeon for perforation of colon during colonoscopy.

Nursing Home Negligence and Abuse

$201,185 arbitration award to a nursing home resident and his wife where the nursing home was found to have negligently failed to prevent falls of a Parkinson’s patient recovering from a hip replacement surgery.  The arbitration panel found that the nursing home failed to use a functioning bed alarm and other suggested preventive measures for this patient at high risk for falls.

$2.45 million jury verdict against a nursing home that deprived plaintiff’s decedent of her nursing home resident’s rights, resulting in multiple falls, bedsores and deprivations of her right to dignity.

$1 million settlement with nursing home for its failure to provide adequate and appropriate health care, resulting in falls, development of bedsores and death.

$1 million settlement with a nursing home for resident’s development of numerous infected pressure sores.

$850,000 settlement with nursing home for negligence resulting in dehydration, fecal impaction and death of resident.

$750,000 settlement with nursing home for failing to prevent falls in an elderly resident who suffered subdural hematoma and death.

$600,000 settlement with nursing home where the resident developed a urinary tract infection, suffered severe weight loss due to inadequate tube feedings, and worsening of bedsores, one of which required surgical removal of a portion of his coccyx.

$578,000 jury verdict against a nursing home facility that violated the resident’s nursing home resident’s rights to adequate and appropriate health care, resulting in a head injury, and amputation of her leg above the knee.

$517,000 arbitration award to a resident and his wife where the nursing home was found to have negligently failed to prevent falls of a cognitively impaired, yet ambulatory resident who was allowed to fall four times within nine days of entering the nursing home. One of the falls resulted in a fractured femur necessitating a total hip replacement and permanent loss of ability to ambulate on his own.

$500,000 settlement in a nursing home action involving severe impaction and intestinal back up of the resident’s feeding tube resulting in death.

$475,000 settlement with a nursing home where the resident suffered severe pressure sores and death.

$450,000 settlement with a nursing home for the death of an above the knee amputee who fell in the shower due to the nursing home’s negligent supervision.

$350,000 settlement with a nursing home its deprivation of plaintiff’s decedent’s nursing home resident’s rights resulting in bedsores, indignity, and other injuries.

$356,300 settlement where the resident suffered general neglect, deprivations of her dignity, and bedsores at a nursing home that later went into bankruptcy. Trentalange & Kelley, P.A., pursued the action for many years until the insurers for the bankrupt chain made satisfactory compensation to the resident’s estate.

$325,000 settlement in Hillsborough County nursing home for falls and negligent care of resident who died of unrelated causes.

$1.6 million settlement of a civil rights case against sheriff and his contract medical provider for deliberate indifference to the serious medical needs of a pregnant female inmate and her son resulting in the baby’s death.

$400,000 settlement with the sheriff and its contract health care provider for their failure to provide timely emergency care to an inmate in respiratory distress.
